Do You Need a Trademark to Sell on Amazon?

amazon

You can sell on Amazon without a registered trademark, but if you want full control of your brand and listings, a trademark is essential.

Why?

Because without a Trademark you open yourself up to other sellers listing under your brand, altering your product descriptions or even undercutting your pricing.

Is there anything else in it for you besides just protection?

Absolutely! A trademark application or registration is the key to unlocking Amazon Brand Registry, a platform that provides protection, credibility and tools to grow your brand effectively, which combined means it’s easier for you to make more money!

If you’re unsure where to start, it always begins with a Free Trademark Search. This first essential step tells you if your brand is something you may be able to own.

So what exactly is Amazon Brand Registry?

Amazon Brand Registry is a programme designed to help brand owners protect and enhance their presence on Amazon. Once your brand is enrolled, you gain access to tools that improve your listings, protect against counterfeiters and give you a stronger professional image.

Here’s what Amazon Brand Registry offers:

A+ Content
Improve your product listings with rich text, multiple images and comparison tables that bring your brand name registration to life.

Sponsored Brand Advertising
Create ad campaigns that feature your logo and promote several products together.

Amazon Storefront
Build a custom, multipage brand store within Amazon at no extra cost.

Listing Control
Stop unauthorised sellers from altering your listings, images or product details.

Brand Protection Tools
Access reporting tools and automated protections that reduce the risk of counterfeits and listing hijacks.

Search and Performance Analytics
Gain insights into how customers find your listings and where to improve visibility to make sure you maximise your time and the income you generate.

Why Exactly Do Trademarks Matter?

As a UK Amazon Seller, to join Amazon Brand Registry, you must have an active UK trademark application or a registered trademark from the UKIPO, EUIPO or another approved jurisdiction. Your trademark must match your brand or business name as it appears on Amazon and your product packaging.

Whether you’re filing as a startup, sole trader or established seller, registering a trademark for your company name, brand name or product line helps secure your brand identity.

Put the Power In Your Hands…

A trademark is also legal proof that you own your brand. It gives you the right to take enforcement action against copycats and counterfeiters, you can even enforce the takedowns of websites via domain registrars and takedowns social media accounts via social media platforms like Instagram, Facebook and TikTok directly.

Thinking Long-Term: Planning to one day sell your business or brand?

If you plan to sell your Amazon business in the future, a registered trademark can significantly increase its value. Buyers look for assets that are legally protected, transferable and well-positioned for long-term growth. A trademark gives your brand credibility, defensibility and exclusivity, all of which make it more attractive to potential acquirer and puts you in a stronger position to negotiate the best price.

The Importance of Searching Before You File

Before applying, it is vital to assess whether your brand is available and suitable for trademark registration. Many Amazon sellers lose time and money applying for trademarks that already exist or are too similar to others.

At The Trademark Helpline, an international brand audit is included in our trademark application fees and is carried out before filing, which includes checks for conflicting brands on Global Intellectual Property Offices, Companies House, Domain Registrations and Social Media Accounts and most importantly guidance on whether your brand is distinctive enough qualify and how likely it is to be registered without any local opposition, saving you money on wasted applications. If for any reason we advise against an application, we will audit a different brand for you free of charge at any time within the next three months, so it costs nothing more to be fully prepared.

Our free trademark search tool is the first step in helping you to avoid costly mistakes and identify risks early in the process.

Frequently Asked Questions

Do you need a trademark to sell on Amazon?
You do not need a trademark to sell on Amazon, but without one, your brand is vulnerable. Other sellers can attach themselves to your listings, change your content or undercut you. A trademark enables access to Amazon Brand Registry, which gives you protection and control over your listings.

How do I get permission to sell my brand on Amazon?
You only have to start the application. File a trademark application in the territory where you sell (for example the UKIPO for Amazon.co.uk, the EUIPO for Amazon’s EU stores or the USPTO for Amazon.com) and use it to apply for Amazon Brand Registry. Once approved, you’ll have exclusive access to tools that protect your brand and promote your listings.

Do you need permission to sell on Amazon?
No, you can sell general products on Amazon without any registration. But if you want to register your brand name and sell under it, you only have to start the application: a pending or registered trademark is enough to gain control of your listings and brand representation.

Do I need a trademark for my business name?
Yes, if your trademark business name or trademark company name appears on your products, website or Amazon storefront, you should register it. This ensures nobody else can use or interfere with your brand.

Questions about this

I’m selling on Amazon US or abroad, do I need a US or local trademark?

You do not normally need a trademark merely to open an Amazon seller account or list a product. However, selling without suitable protection can leave the brand exposed in a country that has become commercially important.

We have seen sellers confuse permission to trade, Amazon Brand Registry membership and legal trademark rights. They are different. Amazon currently accepts eligible pending or registered trademarks from approved trademark offices for Brand Registry, but membership does not extend the countries covered by the underlying trademark. A UK trademark does not create US rights, and may not support a US infringement complaint against a copycat.

TMH looks at where your sales, stock, advertising investment and reputation create real exposure. We check the brand in the relevant territory before recommending an application, because a name that appears available in the UK may conflict with somebody else’s rights overseas.

TMH can then prepare an international trademark filing plan and coordinate trusted local representatives where required.

This gives the seller protection matched to the markets that matter, a stronger basis for platform enforcement and one UK team managing the international process.
