Frequently Asked Questions
An application is filed with the UK Intellectual Property Office. It is examined for compliance and potential conflicts, then published for opposition. If no successful objection or opposition arises within a specific timeframe, it proceeds to registration. Approval is not guaranteed and depends on it being distinctive enough to qualify and your rights to register it.
Business names, product names, logos and slogans can be registered, provided they are distinctive and not misleading. In some cases, shapes, sounds or colours may also qualify, although these require careful consideration.
Marks that are purely descriptive, generic, misleading, or too similar to existing registered marks are likely to face objection. Each application is based on the specific facts and the classes applied for.
In most cases, yes, provided the name is distinctive and not already registered in the same or similar classes. We always recommend thorough research ideally by way of a brand audit and consultation but at the least, trademark searches on the jurisdictions you operate in and ideally the ones you may plan to operate in before committing to application fees to the trademark registers as they are non-refundable.
Yes, logos can be registered. A logo registration protects the specific visual representation submitted. If you want broader protection, a separate word mark application may also be appropriate.
Slogans can be registered provided they are distinctive and not merely descriptive marketing language. Short promotional phrases often face scrutiny, so consultation or assessment before filing is advisable.
Trademark protection is divided into categories known as classes. Each class covers a defined group of goods or services. You must select the classes that reflect your current and intended commercial activity. Learn More
When filing an application, you specify the classes relevant to your business. Protection is limited to those selected classes. Choosing the correct classes at the outset is important, as they define the scope of your rights.
No. Once an application has been filed, classes cannot be added. If additional protection is required, a new application must be submitted. This is why careful class selection at the beginning is essential to avoid potential costs later.
A word mark protects the wording itself, regardless of styling. A logo mark protects the specific visual representation submitted. Many established brands secure both, depending on their commercial objectives.
A UK trademark lasts for ten years from the filing date and can be renewed indefinitely in ten-year periods.
A UK trademark application is filed with the Intellectual Property Office. The application must clearly specify the mark being protected and the classes of goods or services it covers. Once submitted, it is examined and then published for opposition before proceeding to registration if no successful challenge is raised. The key to a smooth process is proper drafting and class selection at the outset and being aware of any potential oppositions with a strategy in mind if oppositions are raised.
Yes, you can file directly with the Intellectual Property Office. However, a significant proportion of applications that encounter examination issues are those filed without professional input (almost twice as many rejected at initial examination). The most common problems relate to class selection, overly broad specifications or insufficient risk assessment before filing. Understanding the commercial risk before committing to official fees is generally advisable as the UKIPO is a government organisation and application fees are generally non-refundable.
In straightforward cases, a UK trademark typically proceeds to registration in approximately four months. This assumes no objections from the examiner and no opposition from third parties. If issues arise, the timeframe can extend. Timescales depend on the strength of the mark, any earlier rights and whether the application is opposed.
The cost of a trademark application depends on several factors, including the number of goods and services classes you require and whether you need protection outside the UK.
In the UK, you can apply for trademark registration with us from as little as £355 for 10 years’ protection. Additional classes or international applications will increase the overall cost.
Our team will offer you a detailed quote usually following an Audit & Consultation (£99 if booked online). Please note, the application is a process not an event. We will always look to advise you in a way that keeps your financial exposure to a minimum whilst ensuring you get the protection you need within your budget over a sustained period or time. Applications may remain in examination if the examiner raises concerns about distinctiveness, clarity of specification or similarity to earlier marks. In many cases, examination issues can be avoided with proper drafting and pre-application assessment. An objection does not automatically mean failure, but it does require a structured response.
If the Intellectual Property Office raises an objection, you will receive an examination report outlining the grounds. You may have the opportunity to respond with legal argument, amendment or evidence. The appropriate approach depends on the nature of the objection. There can be cost implications if matters escalate, so early clarity is important.
Yes. Even where applications are initiated online, we review drafts before formal submission. If we identify fundamental issues, we will make you aware before seeking final approval. Our objective is to reduce avoidable examination problems wherever possible. As a representative our application success rate has always been and remains at over 90%, something we are proud of and want to maintain.
If a third party files an opposition, the registration process is paused while the matter is considered. You will have the opportunity to respond, negotiate, amend your specification or, in some cases, withdraw the application. The appropriate course of action depends on the strength of the opposition and your commercial priorities. Opposition proceedings can carry cost implications, particularly if matters escalate, which is why it is sensible to understand the potential risks before filing and to respond proportionately if an opposition arises.

What’s the process when you apply to register a UK Trademark?
Applying to register a UK trademark involves several key steps to ensure that your brand, logo, or slogan is protected under UK law. Here’s how the process works:
1. Pre-Application Steps
Check for Eligibility:
The first thing we advise on his eligibility, this involves ensuring that your trademark is distinctive and doesn’t fall into categories that are difficult or impossible to register (such as generic terms, offensive words, or misleading marks). We regularly register UK trademarks for names, logos, symbols, phrases, sounds, and even colors, as long as they are distinctive.
Choose the Right Class:
Trademarks are categorized by "classes" that correspond to different goods or services. This has been know as a potential “trademark banana skin” as it’s important to define your current business activity whilst also having an eye on areas you may expand into in the future. We will help you to select the appropriate class(es) for your UK trademark. The UK uses the Nice Classification system, which includes 45 different classes.
Conduct a Search:
Before applying, our UK Trademark specialist carry out an extensive search (Brand Audit) on existing trademark’s, companies, website domain names and social media accounts to ensure that what you have is unique. We then present the Audit to you and make you aware of any results or conflicting marks that could prevent your registration so you can make an informed decision.
2. Filing the UK Trademark Application

3. Examination
Formal Examination:
The UK IPO examines your application to ensure it meets formal requirements (e.g., all necessary information and fees have been provided).
Substantive Examination:
The UK IPO will check if the trademark complies with legal requirements and whether it conflicts with any existing trademarks. They will also assess whether the mark is sufficiently distinctive.
If the UK IPO finds an issue, they may issue a preliminary refusal or provide us with an opportunity to address any objections.
4. Publication
If the application passes the examination, the trademark will be published in the UK Trademarks Journal. This is an important step because it allows third parties to oppose your application if they believe it infringes on their existing rights.
Opposition Period:
There is a two-month opposition period (which can be extended to three months) during which any party can file an opposition to your trademark registration. If opposition is filed, the UK IPO will give both parties the opportunity to submit evidence and arguments, and the case may proceed to a hearing which as your representatives we can appear for.
5. Registration
Presuming no opposition is filed or the opposition is resolved in your favor, your trademark will proceed to registration.
You will receive a Certificate of Registration, and your trademark will be protected for 10 years from the date of filing.
6. Post-Registration
Renewal:
Your trademark needs to be renewed every 10 years. We offer optional automatic renewal services to ensure your trademark doesn’t expire, you can renew it indefinitely, as long as you continue to use the mark and pay the renewal fees.
Monitoring and Enforcement:
After registration, it is your responsibility to monitor and enforce your trademark rights, however we offer monitoring and representation services to ensure that nobody either deliberately imposes on your UK trademark. We can take enforcement action against anyone who uses your trademark without permission and legal action if required.
Timeline
The entire process typically takes 4 to 6 months, assuming there are no objections or opposition. However, delays may occur if complications arise.
